Supreme Court: Judicial Council proceedings against Justice Faiz Jesus stopped

The proceedings against the Supreme Court Judge Qazi Faiz Isa and Sindh High Court Judge Karim Khan Agha on the presidential reference filed against him in the Supreme Judicial Council have been stopped.

This was announced by Pakistan’s Chief Justice Asif Saeed Khosa at a ceremony held in connection with the start of the new court year on Wednesday.

He said that a number of petitions have been filed in the Supreme Court against these presidential references, so the first decision will be decided on these petitions and then the Supreme Judicial Council will proceed to the presidential reference on these judges in light of that decision.

After the presidential reference proceedings against Justice Qazi Faiz Jesus are stopped, they will hear the case again.

Judge Faiz Isa is leading a three-member bench, which will hear different cases, according to a Supreme Court cause list.

More than 6 petitions have been filed in the Supreme Court against Supreme Court Judge Justice Qazi Faiz Isa and Justice K Agha for presidential reference, with objections to the presidential reference and the procedure of the Supreme Judicial Council hearing this reference. Were raised.

These applications have been filed by the Pakistan Bar Council, the Supreme Court Bar Association, the Balochistan High Court Bar Association, the largest advocacy organization, as well as the petition of Justice Qazi Faiz Isa himself.

In a petition filed by the Supreme Court against the presidential reference filed by Justice Qazi Faiz Isa, he requested that his plea be heard by an “honest” judge of the Supreme Court who is not part of the Supreme Judicial Council.

In his petition, Justice Qazi Faiz Isa also raised objections to the presence of the Chief Justice of the Supreme Court and Chief Justice of the Supreme Judicial Council, Asif Saeed Khosa.

The Chief Justice said that the President has the constitutional authority to send a reference against any judge of the High Courts and the Supreme Judicial Council is bound to act on this reference in accordance with the Constitution.

The Chief Justice said that the reference sent by the President or his opinion could not affect the proceedings of the Supreme Judicial Council.

He said that 9 references are now being heard in the Supreme Judicial Council while the remaining references have been dealt with. However, the Chief Justice did not name the judges against whom proceedings are proceeding in the Supreme Judicial Council.

The Chief Justice said that hearing of references against the judges in the Supreme Judicial Council is an unpleasant process for the chairman and his members to go through the process without wanting because the judges cannot violate his oath. ۔
